ABSTRACT

Lelo, S., Kotrošan, D. & Spahić, E. Are fees for writing hunting laws and related statutes worth more than saving ones face? This paper incorporates commentaries of statues and regulations of The Hunting Law of Federation of Bosnia and Herzegovina. These commentaries clearly show that the Ministry of Agriculture, Water Management and Forestry of the Federation of Bosnia and Herzegovina entrusts writing of statutes to amateurs or otherwise irresponsible individuals who’s only goal is receiving the fee. This practice leads us to having the country of Bosnia and Herzegovina protecting species which have never been recorded on its territory.

SUMMARY

In “Hunting papers” we had already discussed mistakes made in biological, or more accurately zoological and taxonomic terms on the checklist of game species within The Hunting Law (Lelo i Spahić, 2007a, 2007b). We had stresses that, in accordance with the International Code of Zoological Nomenclature, names of genera, species and subspecies are always written in italic, while names of other taxonomic categories are written using normal style. We had also stressed that the checklist of game species in itself is inaccurate (it contains species that do not inhabit Bosnia and Herzegovina) and is riddled with mistakes. We supported our arguments by comparing the current law with the “old” Hunting Law from 1991.

When analysing the “The statue of hunting season for game protected by closed season periods and checklist of bird and mammal species considered useful in agriculture and hunting” we have discovered that there are 27 taxonomically unacceptable names of species and inaccurate records for 6 bird species (Luscinia luscinia, Sylvia undata, Hippolais polyglotta, Acanthis flavirostris, Loxia pytyopsittacus and Pyrrhocorax pyrrhocorax) and even one mammalian species (Erinaceus europaeus). Areals of these species does not include Bosnia and Herzegovina, i.e. these species cannot be found on locations listed within the checklist.

All of these facts clearly show that, when writing statutes and regulations for hunting, politicians, within the appropriate Ministries, hire “experts” in accordance with their own preferences and not on the basis of expert’s background and publication history. Some of the published Law and statues (similar to the statute analysed in this paper) are filled with mistakes which lead us to conclude that “experts” hired to write them were only interested in fees so we are asking the title question again: Are fees for writing hunting laws and related statutes worth more than saving ones face?
